I authorise Camberwell Grammar School to debit the nominated account for the payment of the swimmer's swimming lessons at the Camberwell Grammar Aquatic on the Payment Date and to vary the amount of the debit as necessary for changes to the bookings or due to fee increases, as notified in writing by Camberwell Grammar School from time to time. Payment of the swimmer's swimming lessons will be debited under this authority monthly in advance. I acknowledge that it is my responsibility as the swimmer's parent or guardian to have sufficient funds available by the Payment Date and five (5) business days following the Payment Date to permit the direct debit to be processed successfully in accordance with this authority. If a scheduled direct debit payment is rejected or fails for any reason, I will be responsible for all fees and charges incurred to myself and Camberwell Grammar School. This authorisation is to remain in force, with respect to the above account, until I notify Camberwell Grammar School in writing of its cancellation, which must occur at least 14 days prior to the last day of the current billing month, with such notice taking affect from the first day of the next full billing month. Cancellation forms are available from Camberwell Grammar Aquatic reception located next to the pool arena. Where the swimmer is a minor, this Enrolment Form must be signed by the swimmer's parent or guardian. By signing this Enrolment Form, I further confirm, acknowledge and agree that: 1. I am 18 years of age or older; and 2. The information I have provided in this Enrolment Form, including in relation to the swimmer, is true and correct in every particular; and 3. I have read, understood and agree to abide by, the Enrolment Terms and Conditions governing the debit arrangements above and as stated within the Enrolment Handbook; and 4. I will procure the swimmer's agreement to abide by the Enrolment Terms and Conditions as stated within the Enrolment Handbook; and 5. I give permission for Camberwell Grammar School to contact me by my preferred communication method with relevant program information, and any amendments to the fees and charges which are the subject of this authority; and 6. I release Camberwell Grammar School from and waive all claims (including those that arise out of negligence), loss, damage, liability, cost and expense arising out of the swimming classes, the swimmer's participation in the swimming classes and any assistance provided to the swimmer in connection with the swimming classes; and 7. I understand and accept the liability exclusions under the Australian Consumer Law (ACL) and agree: • that nothing excludes, restricts or modifies any term, condition, warranty, guarantee, right or remedy (including but not limited to those guarantees under the ACL) which cannot be lawfully excluded, restricted or modified; and • a term of this Enrolment Form can exclude Camberwell Grammar School's liability for death and personal injury of a swimmer arising from its failure to comply with a consumer guarantee under sections 60 to 62 of the ACL; and • to the extent allowed under section 139A of the Competition and Consumer Act 2010, Camberwell Grammar School excludes all liability in connection with its supply of recreational services for: a) death; or b) physical or mental injury of a swimmer; of c) contraction, aggravation or acceleration of a disease of a swimmer; or d) the coming into existence, or the aggravation, acceleration or recurrence of any other condition, circumstance, occurrence, activity, form of behaviour, course of conduct or state of affairs in relation to a swimmer, that is or may be, or may result in, harm or disadvantage to the swimmer, where the above is a result of Camberwell Grammar School's failure to comply with a consumer guarantee under section 60 to 62 of the ACL; and 8. Camberwell Grammar School acknowledges that the above exclusion of liability will not apply where significant personal injury suffered by a swimmer was due to the reckless conduct of Camberwell Grammar School and/or Camberwell Grammar Aquatic and/or any of its Instructors.
